A Lafayette man was arrested on statutory rape charges this week. Thomas Calvin Phillips III, age 23, is accused of having relations with a minor on or about the date of April 2 and April 14, 2013.
“It is an under-age statutory rape situation,” said Lt. Jason Roberts of the Lafayette Police Department, who took the report. “The mother and juvenile daughter came into the Lafayette Police Department to report their side. Then later on that evening, I spoke with the defendant Mr. Phillips… the information I received led to him being arrested.” The two individuals were acquainted.
The Affidavit of Complaint asserts that Phillips had unlawful sexual penetration of a 15-year-old victim at her Lafayette home. It later reads, “While committing the offense of statutory rape the defendant did take a picture of the victim while engaged in sexual activity with his phone, then at a later date send it to another person’s phone.”
Thomas Calvin Phillips III, 23, of 301 Hwy 52 Bypass, Westmoreland, was arrested on April 16, 2013 for two counts of statutory rape and one count of sexual exploitation of a minor. Court date is set for May 22, 2013. Bond is set for $25,000.
Statutory rape is considered a Class E felony in the state of Tennessee and is punishable by 1-6 years of incarceration and a fine.
